TERMS AND CONDITIONS
1. General Terms
By accessing and using the official website of the Global Union for Intercultural Dialogue (hereinafter referred to as "GUIDE," "we," "us," or "our"), located at guideglobal.org (hereinafter referred to as "the Website"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (hereinafter referred to as "the Terms").
These Terms apply to all users of the Website regardless of whether access is obtained via a computer, mobile device, or any other internet-enabled device, and govern access to and use of all content, features, services, registration tools, forms, and communications made available through the Website and the GUIDE Member Portal (hereinafter referred to as "the Portal"). GUIDE may update these Terms from time to time by publishing the revised version on the Website. Your continued use of the Website following any such update constitutes your acceptance of the revised Terms.
2. About GUIDE
The Global Union for Intercultural Dialogue (GUIDE) is a non-governmental organization registered in the Republic of Azerbaijan. GUIDE operates as the secretariat of the Baku Process and works to promote intercultural dialogue, cultural diversity, and mutual understanding at national, regional, and international levels.
The Website is established to provide information about GUIDE and the Baku Process, enable access to GUIDE's programs and initiatives, facilitate membership and participation applications, provide access to digital resources and tools, and support communication with GUIDE's global network of partners, members, and representatives.
3. Key Definitions
For the purposes of these Terms:
User or You means any person accessing or using the Website or the Portal.
Content includes all text, documents, images, videos, graphics, logos, data, and other materials made available on the Website or through the Portal.
Portal refers to the GUIDE Member Portal, a separate digital environment accessible via the Website, through which users may access membership services, the Multiculturalism Self-Assessment Tool, the Statement on Supporting Intercultural Dialogue application, event registration, and other GUIDE services.
Third-Party Services means services provided by legal entities or individuals other than GUIDE, which are linked to or integrated with the Website or the Portal.
Personal Data means any information relating to an identified or identifiable natural person, as further defined in GUIDE's Privacy Policy.
4. Use of the Website
You agree to use the Website and the Portal solely for lawful purposes, in compliance with the legislation of the Republic of Azerbaijan and any applicable international laws, in a manner consistent with GUIDE's mission and values of intercultural dialogue, mutual respect, and inclusive cooperation, and without disrupting, damaging, or interfering with the security or operation of the Website or the Portal, or attempting to gain unauthorized access to any part thereof.
5. Permission and Access Rights
GUIDE grants you a limited, non-exclusive, non-transferable, and revocable permission to access and use the Website strictly in accordance with these Terms. No ownership rights or proprietary interests in the Website, the Portal, or their Content are transferred to you by virtue of this permission.
In the event of a breach of these Terms, your access to the Website or the Portal may be restricted or terminated at GUIDE's sole discretion without prior notice.
6. Restrictions
You agree not to copy, reproduce, distribute, modify, or commercially exploit any part of the Website, the Portal, or their Content without prior written authorization from GUIDE; reverse engineer, decompile, disassemble, or attempt to derive the source code of the Website or the Portal; remove or obscure any copyright, trademark, or proprietary notices contained on the Website or in its Content; use the Website or the Portal for unauthorized promotional, misleading, or commercial purposes; submit false, inaccurate, or misleading information through any form or application on the Website or the Portal; or impersonate any person or entity or misrepresent your affiliation with any organization.
7. Intellectual Property
All rights in and to the Website, the Portal, and their Content — including but not limited to all text, images, graphics, logos, audio, video, software, and the design, selection, and arrangement thereof — belong to GUIDE, its licensors, or other rightful owners, unless expressly stated otherwise.
The Website, the Portal, and their Content are protected by the legislation of the Republic of Azerbaijan, as well as by applicable international copyright, trademark, and other intellectual property laws.
Unless explicitly permitted under these Terms, the Content may not be copied, altered, reproduced, extracted, stored, published, distributed, or otherwise used, in whole or in part, in any form or by any means, without the prior written consent of GUIDE.
8. User-Submitted Content and Applications
By submitting any application, form, or other content through the Website or the Portal — including membership applications, country representative applications, youth network registrations, internship and volunteer applications, pledge applications, and event registrations — you confirm that all information provided is accurate and complete to the best of your knowledge, and that you have the authority to submit such information on behalf of yourself or the organization you represent where applicable.
GUIDE reserves the right to reject, remove, or decline to process any submission that is found to be inaccurate, misleading, or inconsistent with GUIDE's mission and values.
9. Member Portal
Access to the Portal requires the creation of a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify GUIDE immediately at [email protected] if you become aware of any unauthorized use of your account.
GUIDE reserves the right to suspend or terminate Portal accounts that are found to be in breach of these Terms, or where the account has been inactive for an extended period, without prior notice.
Upon termination of a Portal account, GUIDE will handle the personal data associated with that account in accordance with its Privacy Policy.
10. Third-Party Services and External Links
The Website and the Portal may provide access to or links to Third-Party Services, including but not limited to the United Nations Documents Portal, UNESCO resources, bakuprocess.az, and other external platforms. Access to or use of such Third-Party Services is entirely at the User's own risk.
Any interaction, transaction, registration, or activity carried out through Third-Party Services shall be governed exclusively by the terms, conditions, and privacy policies of the respective third-party service providers. GUIDE does not control, operate, manage, or monitor Third-Party Services and makes no representations or warranties regarding their content, accuracy, availability, functionality, or security. GUIDE shall not be responsible for any liability arising from or related to the User's access to or use of Third-Party Services.
11. Cookies
The Website uses cookies and similar technologies to enhance user experience, analyze website performance, and support the delivery of services. A cookie consent notice is displayed upon your first visit to the Website, through which you may manage your cookie preferences. 12. Suggestions and Feedback
Any feedback, comments, ideas, or suggestions submitted by you to GUIDE regarding the Website, the Portal, or GUIDE's programs and services shall not create any obligation on GUIDE to act upon such submissions. GUIDE may, at its sole discretion, use, incorporate, or publish such feedback without any obligation to provide credit or compensation to you.
13. Website and Portal Modifications
GUIDE reserves the right, at its sole discretion, to modify, suspend, or discontinue the Website or the Portal, in whole or in part, whether temporarily or permanently, without prior notice and without incurring any liability to you. GUIDE may also from time to time provide updates, enhancements, or improvements to the Website or the Portal, which shall be considered an integral part of the respective service and shall remain governed by these Terms.
14. No Warranties
The Website and the Portal are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, GUIDE disclaims all express and implied warranties, including without limitation any warranties relating to the accuracy, reliability, availability, completeness, or fitness for a particular purpose of the Content, and assumes no related obligations. GUIDE does not warrant that the Website or the Portal will operate uninterrupted or be free of errors, viruses, or other harmful components.
15. Limitation of Liability
To the fullest extent permitted by applicable law, GUIDE shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of, or inability to use, the Website, the Portal, or their Content, even if GUIDE has been advised of the possibility of such damages.
16. Notice of Dispute
In the event that a dispute arises between you and GUIDE in connection with these Terms, the Website, or the Portal, either party shall provide the other with a written Notice of Dispute setting out the name and contact information of the party providing the notice, a description of the facts giving rise to the dispute, and a statement of the specific relief sought. Notices of Dispute should be sent to [email protected]. Both parties shall endeavour to resolve any dispute through informal negotiation within sixty days from the date the Notice of Dispute is submitted. Should the dispute not be resolved within that period, either party may initiate legal proceedings.
17. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the legislation of the Republic of Azerbaijan. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts of the Republic of Azerbaijan.
18. Severability
If any provision or portion of these Terms is found to be unenforceable by a court of competent jurisdiction, the remainder of these Terms shall remain in full force and effect.
19. Entire Agreement
These Terms, together with GUIDE's Privacy Policy, constitute the entire agreement between you and GUIDE with respect to your use of the Website and the Portal, and supersede all prior agreements and understandings relating to the same subject matter.
